These terms form an agreement between you and Nicolas Raillot, an individual operator established in France who operates the UpperMax iOS application. By downloading or using the app, you accept them. If you do not accept them, do not use the app.
You must be 18 years old or older to use UpperMax. By using the app, you confirm that you meet this requirement. The onboarding flow asks for your birth month and year. Because it does not ask for the exact day, eligibility begins after your 18th birth month has ended.
UpperMax helps you scan your physique and train selected muscular priorities through a four-week Focus Program. Your guided three-view scan produces a Frame grade and six Physique signals: Shoulder-to-Waist Taper, Leanness, Shoulder Development, Chest Development, Arm Development and Abdominal Definition.
A Focus Session records the prescribed exercises and working sets inside your usual workout. It does not program or track the rest of your workout. The exercises remain stable during the four-week program. Weekly scans measure physique changes; the fourth supports a four-week analysis and selection of the next program. Account XP and progression badges are separate from physique grades and exercise performance.
With your explicit permission, Google Gemini analyzes your body photographs. You grant permission by tapping Continue after reading the disclosure on the scan preparation screen, or leave using the back control without granting permission. You can withdraw permission in Account and privacy to prevent new scan uploads and AI analysis. Nutrition, food logging, dictation, Apple Health and step tracking are not available in the current product.
UpperMax is a fitness and self-tracking tool. It is not a medical device and it does not provide medical advice.
Consult a qualified healthcare professional before beginning a new training program, particularly if you have or suspect an eating disorder, body dysmorphic disorder, an injury, or a condition affected by exercise. If the app's outputs cause you distress, stop using it and speak to someone qualified.
Physique analyses describe visible evidence in photographs. Exercise progress describes the loads and repetitions you record. Neither is a clinical assessment.
Stop an exercise if it causes pain and seek qualified advice. Do not use UpperMax to diagnose a condition, choose medication or make another medical decision. Do not make significant health decisions on the basis of a single analysis or grade.
You are responsible for the security of the account you sign in with and for activity that occurs under it. Provide accurate profile information and record your own working sets. Request account deletion from Account and privacy during onboarding, on the purchase screen or in Profile. Deletion continues in the background, and you can check its receipt after sign-out. It remains pending until the required server and processor deletion steps are verified. See the Privacy Policy for its scope and retention.

The photographs and training records you submit remain yours. You grant us a limited, revocable licence to store and process them to provide your requested physique analyses, Focus Programs and personal history, subject to your privacy choices and applicable law.
Scan photographs and history are kept until you delete them or request account deletion. Historical nutrition records created in earlier versions remain covered by the retention and account-deletion rules in the Privacy Policy. No new nutrition or step-tracking service is offered. Minimal completed deletion receipts remain available for 30 days.
We will never publish your photographs, show them to other users, use them in marketing, or use them to train models operated by UpperMax. The licence for an item ends when it is deleted under the applicable retention rule or when you delete it or your account.
A paid, auto-renewing subscription unlocks complete physique analyses, Focus Programs and Focus Session tracking. Current prices, billing periods and any trial are shown before purchase.

Current prices, billing period and renewal terms are always shown on the purchase screen before you confirm.
We aim to keep the app working but do not guarantee uninterrupted availability. We may add, change or remove features, and may update, suspend or discontinue the app. Where a change materially reduces what you have paid for, we will act reasonably and in accordance with your statutory rights.
You may stop using the app and delete your account at any time. We may suspend or terminate access if you materially breach these terms, in particular section 5. Where practical and lawful, we will tell you why.
To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results. Nothing in this section limits rights you have as a consumer that cannot be limited by law.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of data, or loss of profit arising from your use of the app. Our total aggregate liability is limited to the greater of (a) the amount you paid us in the twelve months before the event, or (b) €50.
We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer in the European Union, your mandatory statutory rights are unaffected by these terms.
If you are a consumer resident in the EU, you benefit from mandatory protections under the law of your country of residence, including applicable withdrawal and conformity rights. Nothing here removes those protections. Use Apple's purchase support for App Store transactions, and contact us about rights or problems relating to the UpperMax service.
The European Commission publishes information about national consumer dispute-resolution bodies at consumer-redress.ec.europa.eu/dispute-resolution-bodies.
These terms are governed by French law. If you are a consumer, you may bring proceedings in the courts of your country of residence, and you retain the protection of the mandatory provisions of that country's law. Before going to court, French law allows you to seek free mediation from a consumer mediator.
We may update these terms. Material changes will be notified in the app before they take effect. Continuing to use the app after that point means you accept the updated terms.
